Please read these Terms carefully before using ACCOUNTability!. By accessing the website or purchasing a scan, you agree to be bound by them.

Important — this is not a background-check or consumer report. ACCOUNTability! is not a consumer reporting agency, and the reports it produces are not "consumer reports" as defined by the U.S. Fair Credit Reporting Act (FCRA) or any equivalent law. You may not use the Service or any report to make decisions about a person's employment, credit, insurance, housing or tenancy, or for any other purpose regulated by consumer-reporting, background-screening, or data-broker laws. See Section 5 (Acceptable Use) and Section 6 (Nature of the Information).

1. Acceptance of these Terms

These Terms & Conditions ("Terms") form a binding agreement between you ("you", "your", or the "User") and ACCOUNTability! ("we", "us", or "our"), the operator of the ACCOUNTability! service available at aipoweredsocialscan.com and api.aipoweredsocialscan.com (together, the "Service").

By accessing the website, creating a request, submitting payment, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Service.

If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms, and "you" includes that organisation.

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. By using the Service you represent and warrant that you meet these requirements and that your use of the Service complies with all laws applicable to you.

The Service is intended only for jurisdictions in which it is lawful. You are responsible for determining whether your use, and your intended use of any Report, is lawful where you and the Subject are located.

4. Description of the Service

ACCOUNTability! is an AI-powered tool that locates and analyses an individual's publicly available social-media posts across the Platforms and produces an automated Report. The analysis uses artificial-intelligence models to identify content the models classify as potentially concerning (for example, hateful, extremist, deceptive, or otherwise high-risk content) and to assess overall tone, and to assemble the other elements of the Report described in Section 2.

When you submit a request you may be asked to state a purpose (for example self-checking, dating, influencer vetting, or "other"). Selecting or describing a purpose does not authorise any use prohibited by Section 5, and we may decline or cancel any request at our discretion.

The Service relies on third-party Platforms and data sources that we do not control. Coverage, completeness, and availability of Public Data vary and are not guaranteed. The Service is provided on a per-scan basis and does not include any ongoing monitoring unless we expressly state otherwise.

5. Acceptable Use & Prohibited Uses

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for your use of the Service and of any Report.

5.1 Not for FCRA / consumer-reporting or background-screening purposes

The Service is not a "consumer reporting agency" and a Report is not a "consumer report" or "investigative consumer report" within the meaning of the U.S. Fair Credit Reporting Act (FCRA) or any equivalent consumer-reporting, background-screening, or data-protection law in any jurisdiction. You must not use the Service, a Report, or any information in it, in whole or in part, as a factor in:

If you need information for any of the purposes above, you must obtain it from a properly authorised consumer reporting agency or licensed background-screening provider that complies with the applicable law.

5.2 Other prohibited uses

You must not use the Service or any Report to:

You represent and warrant, each time you use the Service, that: (a) your purpose is lawful and permitted under these Terms; (b) you will comply with all laws applicable to you and to your use of any Report, including data-protection, privacy, anti-discrimination, and consumer-protection laws; and (c) you will independently verify any information before relying or acting on it (see Section 6). We may refuse, suspend, or cancel any request, and may report unlawful activity to the relevant authorities.

6. Nature of the Information & AI Limitations

You acknowledge and accept the following about the Service and every Report:

You agree that you, and not ACCOUNTability!, are solely responsible for any interpretation of, decision based on, or action taken in reliance on a Report.

7. No Warranty; No Professional Advice

The Service and all Reports are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any Report will be accurate, complete, or reliable.

The Service does not provide legal, financial, medical, employment, investigative, security, or other professional advice, and no Report is a substitute for professional judgement or for advice from a qualified professional. Nothing in this Section limits any warranty or right that cannot be excluded under applicable mandatory consumer-protection law in your jurisdiction.

8. Data Protection & Privacy

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms.

Roles. A Subject is a data subject under the EU/UK General Data Protection Regulation (GDPR) and similar laws, but is not our customer. With respect to the personal data contained in a Report, the parties' respective roles as "controller" and/or "processor" are as set out in the Privacy Policy and depend on your purpose; you should not assume we act as your processor.

Lawful basis. Where the GDPR applies, our processing of a Subject's Public Data for the purpose of locating it, analysing it, and delivering a Report relies on our and our users' legitimate interests under Article 6(1)(f) GDPR, subject to a balancing of the Subject's rights and freedoms, except where another basis applies. Where a Subject's request relates to special-category data, additional conditions apply and we limit processing accordingly.

Your responsibilities. When you use a Report you may yourself become a controller of the personal data in it. You are responsible for having your own lawful basis for any further processing, for honouring data-subject rights in relation to data you retain, and for complying with transparency, security, retention, and cross-border-transfer obligations that apply to you.

Subject rights. A Subject (or any individual) may exercise data-protection rights — including access, rectification, erasure, restriction, and the right to object to processing based on legitimate interests — by contacting us at team@aipoweredsocialscan.com. Where we rely on legitimate interests and a person objects, we will stop the relevant processing unless we can demonstrate compelling legitimate grounds that override their interests, rights, and freedoms, or the processing is needed to establish, exercise, or defend legal claims.

Retention. We retain Reports and associated data only as long as necessary for the purposes described in the Privacy Policy and as required by law. We retain Reports and their associated scan data for 90 days from delivery, after which they are deleted or anonymised, unless a longer period is required to comply with a legal obligation or to establish, exercise, or defend legal claims.

9. Pricing, Payment & Refunds

Price. The current price of a single scan is €15 (fifteen euro), unless a different price is shown to you at the time of purchase. The price of €15 is inclusive of any applicable value-added tax (IVA). Prices may change for future purchases.

Payment. Payments are processed by our third-party payment provider, Stripe. By submitting payment you authorise us, through Stripe, to charge the stated amount. We do not store full card details. Your use of Stripe is also subject to Stripe's terms and privacy policy.

When processing begins. Because the Service is a digital service that is performed and delivered to you immediately, you expressly request and consent that we begin processing your scan as soon as payment is confirmed, and you acknowledge that this may cause you to lose any statutory "cooling-off" right of withdrawal that would otherwise apply to distance contracts once the service has been fully performed.

Refunds. Fees are generally non-refundable once a scan has begun processing, because computing, AI, and third-party data costs are incurred at that point. If the Service suffers a material technical failure that prevents us from delivering a Report to you, we will, at our discretion, re-run the scan or refund the fee for that scan. If you cancel before your scan has begun processing, you are entitled to a full refund; in practice, processing usually begins within moments of payment, so this window is short. We may also issue refunds, or partial refunds, at our discretion as a gesture of goodwill, and where required by mandatory consumer-protection law.

10. Intellectual Property

The Service, including its software, design, text, graphics, the ACCOUNTability! name and wordmark, the layout and presentation of Reports, the word-portrait format, and all related intellectual-property rights, are owned by or licensed to us and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to access the Service and to use the Report you purchase for your own lawful, permitted internal purpose, subject to these Terms.

Underlying Public Data, posts, images, and the Subject's own words remain the property of their respective owners and are presented for analysis and reference only. You may not remove proprietary notices, and you may not reproduce, distribute, or create derivative works from the Service or a Report except as expressly permitted.

11. Third-Party Platforms & Trademarks

ACCOUNTability! is an independent service. We are not affiliated with, endorsed by, sponsored by, or in any way officially connected to X Corp. (X / Twitter), Meta Platforms, Inc. (Facebook, Instagram), LinkedIn Corporation, TikTok / ByteDance, Stripe, or any other Platform or provider. All product names, logos, and trademarks are the property of their respective owners and are used only for identification and descriptive purposes.

Your use of any Platform remains governed by that Platform's own terms. The Service may link to or display content hosted by third parties; we are not responsible for that content or for third-party websites, and following such links is at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law, ACCOUNTability! and its owners, officers, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or reputation, arising out of or relating to the Service or any Report, whether based on contract, tort (including negligence), statute, or otherwise, even if advised of the possibility of such damages.

In particular, and without limiting Section 6, we are not liable for any decision you make, or any action you or any third party takes, in reliance on a Report, including any misidentification, inaccuracy, or AI-generated error, or for any use of the Service that breaches Section 5.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the scan giving rise to the claim, or (b) €100 (one hundred euro).

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that applicable mandatory law does not allow to be excluded.

13. Indemnification

You agree to indemnify, defend, and hold harmless ACCOUNTability! and its owners, officers, employees, contractors, and suppliers from and against any claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the Service or any Report; (b) your breach of these Terms, including any prohibited use under Section 5; (c) your violation of any law or of the rights of any third party (including any Subject); or (d) any decision or action you take in reliance on a Report.

14. Modifications to the Service and these Terms

We may change, suspend, or discontinue any part of the Service at any time, including the Platforms covered, features, and pricing for future purchases. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where the change is material, take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to a change, you must stop using the Service.

15. Suspension & Termination

We may suspend or terminate your access to the Service immediately and without notice if we reasonably believe you have breached these Terms (including Section 5), used the Service unlawfully, or created risk or legal exposure for us, a Subject, or others. Sections that by their nature should survive termination — including Sections 5, 6, 7, 8, 10, 12, 13, 16, and 17 — will survive.

16. Governing Law & Dispute Resolution

These Terms, and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes), are governed by the laws of Spain, without regard to conflict-of-laws rules.

The courts of Madrid, Spain will have exclusive jurisdiction, except that where you are a consumer you may benefit from any mandatory protections and the right to bring proceedings in the courts of your country of residence, where applicable law so provides.

Before commencing formal proceedings, the parties will use good-faith efforts to resolve any dispute amicably by contacting team@aipoweredsocialscan.com and allowing a reasonable period to respond. If the dispute cannot be resolved that way, it may be referred to the courts identified above. Nothing in these Terms limits any mandatory right you may have as a consumer to refer a dispute to a competent alternative dispute resolution (ADR) body or consumer-protection authority available to you under the law of your country of residence.
